2. About Baseball5 Nation

Baseball5 Nation is an organization dedicated to promoting and developing Baseball5 in the Washington DC, Maryland, and Virginia (DMV) area. We provide:

• Competitive winter leagues for youth and adult players
• School implementation programs and curriculum materials
• Training clinics for coaches, teachers, and athletic coordinators
• Community outreach and scholarship opportunities
• Educational content about Baseball5 rules, techniques, and benefits

3. Eligibility and Registration

3.1 Age Requirements

• Youth Programs (11-17): Participants under 18 must have parental or guardian consent
• Adult Programs (18+): Open to all adult participants
• School Programs: Available to schools and organizations serving students of appropriate age groups

3.2 Registration Accuracy

You agree to provide accurate, current, and complete information during registration and to update such information as necessary. Providing false or misleading information may result in suspension or termination of your participation.

3.3 Account Security

If you create an account on third-party platforms (such as TeamLinkt for league registration), you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Program Participation

4.1 Code of Conduct

All participants, parents, and spectators agree to:

• Treat all players, coaches, officials, and staff with respect
• Follow WBSC Baseball5 official rules and regulations
• Refrain from discriminatory, abusive, or unsportsmanlike behavior
• Prioritize safety and fair play
• Follow facility rules and guidelines
• Respect the co-ed nature of Baseball5 and promote gender equity

Violation of the code of conduct may result in removal from programs without refund.

4.2 Health and Safety

Participation in Baseball5 involves physical activity and inherent risks. By participating, you acknowledge and accept these risks. You agree to:

• Ensure you (or your child) are physically capable of participating
• Disclose any medical conditions that may affect participation
• Provide emergency contact information
• Follow safety instructions from coaches and officials
• Provide your own health insurance coverage

4.3 Assumption of Risk and Liability Waiver

You understand and acknowledge that participation in Baseball5 activities involves risks, including but not limited to, injuries from physical contact, falls, collisions, and equipment use. By participating, you voluntarily assume all risks and waive any claims against Baseball5 Nation, its directors, officers, employees, volunteers, partner schools, and facilities for injuries or damages arising from participation, except in cases of gross negligence or willful misconduct.

5. Payment and Refund Policy

5.1 Registration Fees

Program fees are specified during registration and must be paid in full unless a payment plan is arranged. Fees cover league administration, facility costs, equipment, officiating, and program materials.

5.2 Refunds

• Full Refund: Available if requested more than 14 days before program start date
• Partial Refund (50%): Available if requested 7-14 days before program start
• No Refund: Within 7 days of program start or after the program has begun
• Injury/Medical: Prorated refunds may be considered with medical documentation
• Program Cancellation: Full refund if Baseball5 Nation cancels a program

5.3 Scholarships

Baseball5 Nation offers need-based scholarships and financial assistance. Contact us at info@baseball5nation.com to inquire about scholarship opportunities.

6. Intellectual Property

6.1 Website Content

All content on baseball5nation.com, including text, graphics, logos, images, videos, and curriculum materials, is the property of Baseball5 Nation or its content suppliers and is protected by U.S. and international copyright laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

6.2 WBSC Rules and Materials

Baseball5 official rules and certain educational materials are provided by the World Baseball Softball Confederation (WBSC). We have permission to use and distribute these materials for educational and promotional purposes. These materials remain the property of WBSC.

6.3 User-Generated Content

If you submit content to Baseball5 Nation (such as testimonials, photos, or feedback), you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, modify, and display such content for promotional and educational purposes.

6.4 Media Release

By participating in Baseball5 Nation programs, you consent to being photographed, filmed, or recorded for promotional, educational, and archival purposes. These materials may be used on our website, social media, and marketing materials. If you wish to opt out, please contact us in writing.

7. Website Use

7.1 Prohibited Activities

You agree NOT to:

• Use the website for any unlawful purpose
• Attempt to gain unauthorized access to any part of the website

8. School and Organization Programs

8.1 Curriculum Materials

Schools that receive Baseball5 curriculum materials through our programs may use them solely for educational purposes within their institution. Redistribution, resale, or commercial use is prohibited without written permission.

8.2 Equipment Kits

Equipment provided through school partnership programs remains the property of the school and should be used for Baseball5 instruction and play. Baseball5 Nation is not responsible for lost, stolen, or damaged equipment after delivery.

8.3 Partnership Agreements

Schools and organizations entering formal partnerships with Baseball5 Nation may have additional terms outlined in separate agreements. Those terms supplement but do not replace these general Terms of Service.

9. Disclaimers and Limitation of Liability

9.1 "As Is" Basis

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 Limitation of Liability

To the fullest extent permitted by law, Baseball5 Nation, its directors, officers, employees, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of our Services or participation in programs, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the specific program or service.

9.3 Indemnification

You agree to indemnify, defend, and hold harmless Baseball5 Nation from any claims, damages, losses, or expenses (including attorneys' fees) arising from your violation of these Terms, your use of our Services, or your participation in programs.

10. Modification and Termination

10.1 Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our Services after changes constitutes acceptance of the modified Terms.

10.2 Program Changes

Baseball5 Nation reserves the right to modify program schedules, locations, or content as necessary due to weather, facility availability, enrollment numbers, or other factors. We will make reasonable efforts to notify participants of significant changes.

10.3 Termination of Access

We reserve the right to suspend or terminate your access to our Services or participation in programs if you violate these Terms or engage in conduct that we deem harmful to other participants, staff, or the organization.

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the District of Columbia, without regard to its conflict of law provisions.

11.2 Informal Resolution

Before pursuing formal legal action, you agree to contact us at info@baseball5nation.com to attempt to resolve any disputes informally.

11.3 Arbitration

If informal resolution is unsuccessful, any disputes shall be resolved through binding arbitration in Washington, DC, rather than in court, except that you may assert claims in small claims court if your claims qualify.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Baseball5 Nation regarding your use of our Services and supersede all prior agreements and understandings.
